Terms of Service — TikalLoyalty

These Terms of Service govern your use of the TikalLoyalty mobile app, operated by Servicios Avanzados en Tecnología, S.A. (Guatemala). By using the app, you accept these terms.

1. Acceptance

By creating an account or using TikalLoyalty, you accept these Terms and our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use the app. If you are a minor under the law of your country, you must have the consent of a parent or guardian.

3. The service

TikalLoyalty is a platform that lets customers participate in the loyalty programs of merchants ("franchises") that use TikalPOS. Points and rewards are defined, issued, and administered by each franchise, not by Servicios Avanzados en Tecnología, S.A.. We act as the technology platform provider.

4. Your account

You are responsible for providing accurate information and keeping your login credentials secure. Notify us immediately if you detect unauthorized use of your account.

5. Points and rewards

  • Points are earned and redeemed according to each franchise’s rules.
  • Points have no monetary value, are not transferable outside the mechanisms provided by the platform, and are not redeemable for cash.
  • Each franchise is responsible for fulfilling the rewards it offers. Servicios Avanzados en Tecnología, S.A. does not guarantee the availability or fulfillment of a specific reward by a franchise.
  • A franchise may modify or discontinue its reward catalog and point validity according to its own policies.

6. Acceptable use

You agree not to:

  • Use the app for fraudulent or unlawful purposes.
  • Attempt to gain unauthorized access to systems, accounts, or data.
  • Interfere with the operation of the app or circumvent its security measures.

7. Intellectual property

The app, its brand, design, and software are owned by Servicios Avanzados en Tecnología, S.A. and protected by applicable laws. You acquire no rights to them beyond the use permitted by these Terms.

8. Disclaimer of warranties

The app is provided "as is" and "as available." To the extent permitted by law, we make no warranty that the service will be uninterrupted or error-free.

9. Limitation of liability

To the extent permitted by law, Servicios Avanzados en Tecnología, S.A. is not liable for indirect, incidental, or consequential damages arising from use of the app, nor for a franchise’s failure to fulfill rewards.

10. Termination

You may stop using the app and request account deletion at any time. We may suspend or terminate access if you breach these Terms or for operational or legal reasons.

11. Governing law

These Terms are governed by the laws of the Republic of Guatemala, without prejudice to the rights you may have as a consumer.

12. Changes

We may update these Terms. We will post the current version on this page with its update date. Continued use after a change means you accept it.

14. Reviews and user content

If you post a review or other content about a merchant, you agree to the following:

  • Author responsibility: you are solely responsible for the content you post. It must be truthful, based on your real customer experience, and must not infringe third-party rights.
  • Intermediary, not author: Servicios Avanzados en Tecnología, S.A. acts as an intermediary that hosts and displays user reviews. Reviews reflect their authors' opinions, not ours; we do not adopt them as our own or warrant their accuracy.
  • License: you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your review within the app and related materials for as long as you keep it published.
  • Prohibited conduct: no false or defamatory content, abusive, discriminatory, or threatening language, third-party personal data (doxxing), spam or links, conflict of interest (e.g. competitors), extortion, or off-topic content.
  • Moderation and takedown: we moderate by public, objective rules and may remove content that breaks them. The reviewed merchant cannot delete reviews; it may only reply once and report by closed causes, which we review against these rules. Reviews are never bought or conditioned.
  • Disclaimer: to the extent permitted by law, Servicios Avanzados en Tecnología, S.A. is not liable for content posted by users. Once a review's window elapses, its publication is inevitable and cannot be blocked by the merchant.

15. Complaints about merchants and merchants who fail to deliver

TikalLoyalty is a platform that connects customers with affiliated merchants. Rewards, promotions, and services are defined and delivered by each merchant; the merchant is solely responsible for honoring what it offers its customers.

If a merchant fails to deliver what it offered (for example, refusing to honor a valid reward or breaking a published promotion), you can send us a complaint at quejas@tikalpos.com with the details of the case.

  • We analyze every complaint and, where appropriate, contact the merchant to understand the specific situation.
  • If a merchant accumulates recurring complaints, Servicios Avanzados en Tecnología, S.A. may, at its discretion, suspend or remove the merchant from the platform, withdrawing all of its content (profile, rewards, reviews, and others).
  • These measures aim to protect users' trust in the platform. Servicios Avanzados en Tecnología, S.A. acts as an intermediary and does not guarantee or take responsibility for the products, services, or promises of affiliated merchants; your consumer relationship is directly with the merchant.

16. Age-restricted products

Some merchants offer products whose sale and consumption are restricted by law to people who meet the legal age in their country (for example, alcoholic beverages or tobacco/vaping products). These rewards are shown with a visible indicator.

  • The first time you open a reward marked as age-restricted, we will ask you to confirm that you meet the applicable legal age. This confirmation is your own declaration; we do not request your date of birth.
  • Age verification is performed by the merchant at the point of sale or upon delivery. The merchant may refuse delivery if you cannot prove the legal age.
  • Servicios Avanzados en Tecnología, S.A. acts as a technology intermediary and does not sell or deliver these products. The merchant is solely responsible for complying with the laws applicable to the sale of restricted products.
  • Falsely declaring that you meet the legal age constitutes a breach of these Terms.
